1. Agreement to Terms

Welcome to JamStage, a social rhythm game developed and operated by CM Holdings USA, Inc. ("Company," "we," "our," or "us"). By downloading, installing, or using JamStage ("the App"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, do not use the App. These Terms apply to all users of JamStage, including visitors, registered users, and others who access the service.

These Terms should be read alongside our Privacy Policy, which is incorporated by reference.

The App displays advertisements. For details on how advertising works, what data is collected, and your choices (including how to opt out of personalized ads), please review Section 4.3 of our Privacy Policy.

2. Eligibility and Account Registration

2.1 Age Requirements

You must be at least 13 years of age to use JamStage. If you are under 18, you represent that you have your parent or guardian's permission to use the App and that they have read and agreed to these Terms on your behalf.

2.2 Account Creation

To access most features of JamStage, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

2.3 One Account Per User

Each user may maintain only one account. Creating multiple accounts to circumvent suspensions, gain unfair advantages, or for any other reason is prohibited and may result in permanent bans of all associated accounts.

3. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use JamStage for your personal, non-commercial purposes.

You may not:

  • Copy, modify, or distribute the App or its content
  • Reverse engineer, decompile, or disassemble the App
  • Sublicense, sell, resell, transfer, or otherwise commercially exploit the App
  • Use the App for any unlawful purpose or in violation of these Terms
  • Remove any proprietary notices or labels from the App

4. Acceptable Use Policy

You agree to use JamStage only for lawful purposes and in a manner that does not infringe on the rights of others. You must not:

4.1 Prohibited Conduct

  • Cheat, hack, or use unauthorized third-party software to gain unfair advantages
  • Exploit bugs or glitches rather than reporting them to us
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Harass, bully, threaten, or intimidate other users
  • Use offensive, hateful, or discriminatory language in usernames, crew names, or any user-generated content
  • Engage in spamming, phishing, or any form of automated data collection
  • Attempt to gain unauthorized access to other accounts or our systems
  • Disrupt or interfere with the integrity or performance of the App
  • Share account credentials with others or sell/transfer accounts

4.2 Fair Play

JamStage is committed to fair competition. Any attempt to manipulate scores, rankings, tournament results, or leaderboards—whether through technical means or collusion with other players—is strictly prohibited and will result in immediate account termination.

4.3 Community Moderation and Reporting

JamStage maintains a zero-tolerance policy for objectionable content, harassment, and abusive behavior in all user-generated areas of the App, including but not limited to Crew Chat, Fan Stage posts and comments, Champion Showcase videos, usernames, and crew names.

In-App Reporting and Blocking Tools:

  • Report Function: You can report any user, message, comment, post, or uploaded content directly within the App. Reported items are added to our moderation queue for review.
  • Block Function: You can block any other user, preventing them from sending you messages, commenting on your content, or interacting with you in shared spaces such as Crew Chat.
  • Username Filtering: Usernames are automatically checked against a list of prohibited terms (in multiple languages) at the time of creation; names containing banned language are rejected.
  • Content Review: User-generated content (chat messages, comments, uploaded videos) is reviewed reactively through user reports and our internal review processes. We continue to develop and refine our content review systems.

Response Commitment:

  • Standard reports: reviewed within 1 business day of submission (Monday–Friday, excluding U.S. federal holidays).
  • Urgent safety concerns (immediate threats of harm, child safety issues, illegal content): prioritized and reviewed as soon as practicable, including outside of standard business hours.
  • Confirmed violations may result in content removal, account warnings, temporary suspensions, or permanent bans without refund of any virtual currencies or purchases.

The Company reserves the right to remove any user-generated content, suspend, or permanently terminate any account at any time, with or without prior notice, to maintain a safe community environment. Users who repeatedly violate our community standards will have their accounts terminated.

5. Virtual Currency and In-App Purchases

Important: Virtual Currency Terms

JamStage uses a multi-tier virtual currency system. Please read this section carefully before making any in-app purchases.

5.1 Currency System

JamStage uses the following virtual currencies:

  • Gem: Purchased directly via In-App Purchase (IAP). Used to acquire Dance Tickets.
  • Dance Ticket (DC): In-game currency converted from Gems. Used to participate in competitions and events.
  • Gold: Earned through gameplay, competitions, and events. Cannot be purchased directly.

5.2 In-App Purchase Terms

  • All IAP purchases (Gems) are processed through Apple App Store or Google Play Store and are subject to their respective terms and policies.
  • All sales are final. Refunds are subject to the platform's (Apple/Google) refund policies.
  • Virtual currencies and items have no cash value and cannot be exchanged for real money.
  • We reserve the right to change pricing for any in-app purchases at any time.

5.3 VIP Membership and Subscriptions

If JamStage offers VIP membership or subscription services:

  • Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.
  • Cancellations take effect at the end of the current billing period.
  • Refunds for subscriptions are subject to Apple App Store or Google Play Store policies.
  • VIP benefits are personal and non-transferable.

6. User-Generated Content

6.1 Camera and Video Content

JamStage may allow you to record videos during gameplay (1:1 Challenge camera mode) and optionally create and share highlight reels (Champion Showcase). By creating and sharing content through JamStage, you:

  • Grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your content solely for the purpose of operating and improving the App.
  • Represent that you have all necessary rights to the content you submit.
  • Understand that Champion Showcase highlight videos will be publicly visible to other users.
  • Acknowledge that uploaded videos are stored for up to 1,000 days before automatic deletion.

6.2 Content Standards

You must not create or share content that:

  • Is illegal, harmful, threatening, abusive, or harassing
  • Infringes on any third party's intellectual property rights
  • Contains nudity, sexual content, or graphic violence
  • Promotes discrimination, hatred, or harm against any individual or group
  • Contains personally identifiable information of others without their consent
  • Violates any applicable laws or regulations

6.3 Content Removal

We reserve the right to remove any content that violates these Terms or that we determine, in our sole discretion, to be harmful, offensive, or otherwise objectionable.

7. Gameplay, Competitions, and Crew System

7.1 Competitions and Tournaments

JamStage offers various competitive modes including 1:1 Challenge, Sync Challenge, and Crew Challenge (weekday score battles and weekend boss raids). By participating, you agree that:

  • Competition results are determined by the App's scoring systems and are final.
  • The Company reserves the right to cancel, modify, or suspend any competition at any time.
  • Prizes, rewards, or virtual currency earned through competitions may be adjusted or revoked if violations are discovered after the fact.
  • Any attempt to manipulate competition results will result in immediate disqualification and potential account suspension.

7.2 Crew System

Crews are social groups within JamStage. Crew leaders and members agree to:

  • Use crew names and descriptions that comply with our content standards.
  • Treat all crew members with respect and not engage in harassment or exclusionary behavior.
  • Accept that crew membership, rankings, and rewards are subject to our fair play policies.

We reserve the right to dissolve crews, remove members, or reset crew rankings in cases of policy violations.

8. Intellectual Property

JamStage and all its contents, features, and functionality—including but not limited to software, text, graphics, logos, music, and game design—are owned by CM Holdings USA, Inc. and are protected by applicable intellectual property laws.

The music, choreography references, and rhythm patterns used in JamStage are licensed or created by the Company. You may not extract, reproduce, or distribute any music or content from the App without prior written permission.

If you believe that any content in the App infringes your copyright, please contact us at tech@cmholdingsusa.com with a detailed description of the alleged infringement.

9. Disclaimers and Limitation of Liability

9.1 Disclaimer of Warranties

JamStage is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that:

  • The App will be uninterrupted, error-free, or secure
  • Any defects or errors will be corrected
  • The App or its servers are free of viruses or other harmful components
  • Results obtained from the App will be accurate or reliable

9.2 Physical Activity Disclaimer

Health and Safety Notice

JamStage involves physical activity (dancing). Before using the App, ensure you have adequate space around you. We are not responsible for any injuries, property damage, or accidents that occur during gameplay. If you have any medical conditions, consult a healthcare professional before engaging in dance activities.

9.3 Limitation of Liability

To the maximum extent permitted by applicable law, CM Holdings USA, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, virtual currency, or game progress
  • Personal injury or property damage
  • Unauthorized access to or alteration of your account
  • Any other matter relating to the App

Our total liability to you for any claims arising out of or relating to these Terms or the App shall not exceed the amount you paid us in the six (6) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless CM Holdings USA, Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your user-generated content.

11. Account Suspension and Termination

11.1 Termination by Us

We reserve the right to suspend or terminate your account and access to the App at our sole discretion, with or without notice, for any reason including:

  • Violation of these Terms or our policies
  • Fraudulent, abusive, or illegal activity
  • Discontinuation of the App or relevant features

11.2 Termination by You

You may terminate your account at any time by contacting us at tech@cmholdingsusa.com or through the account deletion feature in the App settings.

11.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Virtual currencies, game progress, crew memberships, and all in-game items associated with your account will be forfeited without compensation.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If that fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, conducted in Los Angeles County, California.

You waive any right to participate in class-action lawsuits or class-wide arbitration against the Company.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make significant changes, we will notify you by:

  • Posting a notice within the App
  • Sending an email to the address associated with your account
  • Updating the "Last Updated" date at the top of this page

Your continued use of JamStage after changes are posted constitutes your acceptance of the updated Terms.
